An FCT High Court on Monday
in Abuja dismissed a suit filed by residents of Chikakore Layout in
Byazhin, Kubwa, asking the court to stop the Federal Capital Territory
Administration (FCTA), from revoking their plots of land.
In
his ruling, Justice Yusuf Halilu said plots in the layout were not duly
allocated by the Bwari Area council, adding that any land allocation in
the FCT that did not emanate from the FCT minister was not genuine.
The
judge said that the Land Use Act which vested all land within the
territory of each state on the governor the state, was not applicable to
the FCT.
“The
Federal Government through the FCT Act of 2004 intended for Abuja a
vast expanse of land devoid of cultural or hereditary inclination,” he
said. “It is my view that the reliefs sought by the plaintiffs against
the defendants must fail, and the entire suit is consequently
dismissed.’’
